twIIgs Terms of Service

These Terms of Service ("Terms") govern your use of twiigs.co, shop.twiigs.co, design.twiigs.co, presale.twiigs.co, and any related tools or services (the "Services"), and your purchase of products from twIIgs LLC ("twIIgs," "we," "us").

By using the Services or placing an order, you agree to these Terms. If you do not agree, do not use the Services.

Who we are

twIIgs LLC is a Utah limited liability company located at 55 N 400 W, Logan, UT 84321. You can reach us at liam@twiigs.co.

Eligibility

You must be 18 or older to place an order. If you are under 18, a parent or legal guardian must place the order and agree to these Terms on your behalf. By ordering, you confirm you meet this requirement.

Orders and pricing

Placing an order is an offer to buy. We accept your offer when we charge your payment method and send an order confirmation.

We may decline or cancel any order, including for pricing errors, suspected fraud, or inventory we cannot fulfill. If we cancel, we refund you in full.

Prices are in US dollars and may change without notice. Utah sales tax is applied where required. The price in effect when we accept your order is the price that applies.

Shipping timelines

Our products are built to order and some components are manufactured overseas. The estimated shipping window is stated on the product page and in your order confirmation.

If we cannot ship within the stated window, we will notify you by email with a revised date and offer you the choice of waiting or receiving a full refund. You do not need to accept a delay.

Estimated dates are estimates. Supply chain, manufacturing, customs, and carrier delays can move them.

Custom orders and final sale

Most twIIgs poles are built to the configuration you create in our design tool.

Custom orders are final at the time of purchase. Once you place an order, the design cannot be changed, and the order cannot be cancelled, returned, or exchanged for a change of mind, including a change of mind about color.

Review your design carefully before you check out.

This does not limit your rights if the product is defective, damaged in transit, or different from what you ordered. Those are covered in our Refund and Warranty Policy.

Color accuracy

Colors on your screen will not match the physical product exactly. Screen calibration, display settings, ambient lighting, and the finish of the material all affect how a color appears. Variation between production batches is normal and is not a defect.

Your design, and our use of it

You may create color configurations using our design tool. You keep whatever rights you have in the arrangement you create.

By submitting a design to us, you grant twIIgs a perpetual, worldwide, royalty-free license to produce that design, and to display, reproduce, and modify it in our marketing, product galleries, social media, and other materials. This license covers the design configuration only. It does not cover your name, your likeness, or photographs you take.

If you tag us or send us photos of your poles, we will ask before using them.

You may not submit designs that infringe a third party's trademark or copyright, or that are unlawful, hateful, harassing, or obscene. We may refuse or cancel any design at our discretion.

Our intellectual property

The twIIgs name, logo, product designs, the stacked ring and ledge system, site content, photography, copy, and the design tool are owned by or licensed to twIIgs. Patent applications are pending.

You may not copy, reproduce, reverse-engineer, or create derivative works from our products, tools, or content without written permission.

Acceptable use

Do not attempt to interfere with, overload, scrape, or gain unauthorized access to the Services. Do not use the design tool to submit automated or bulk requests. Do not misrepresent your identity or use the Services for any unlawful purpose.


PRODUCT USE, RISK, AND WARNINGS

Read this section carefully. It describes how our products can fail and what you are responsible for.

Inherent risk

Backcountry skiing, ski touring, resort skiing, splitboarding, hiking, and trekking involve inherent risks, including avalanche, falls, collision, terrain hazards, weather, equipment failure, serious injury, permanent disability, and death. These risks exist regardless of the equipment you use and cannot be eliminated.

You are responsible for evaluating terrain and conditions, for your own skill, fitness, and judgment, and for deciding whether and how to use our products in a given situation.

What our poles are, and are not

twIIgs poles are balance, support, and propulsion aids for skiing, splitboarding, hiking, and trekking.

They are not safety equipment. They are not rescue equipment, anchors, fall-arrest devices, avalanche probes, splints, tent poles, or self-arrest tools. Do not use them for any of these purposes.

Ring and ledge system

Our poles use stackable TPE rings and larger ledge discs that create push points along the upper shaft. Using a ledge means applying load to the shaft at a point below the grip. You should understand the following before using them.

  • Loading a pole shaft below the grip places stress on the shaft in a way that differs from normal grip use. Aluminum and carbon fiber shafts can bend or break under load.
  • Ledges and rings are thermoplastic components. They can deform, crack, split, or fail, particularly in cold temperatures, under repeated heavy loading, or after impact damage.
  • Rings may compress slightly with use. Over time this can open a small gap at the top of the ring stack, just under the top cap. This is normal. Extra rings are included with your order and can be added to close the gap.
  • Rings and ledges can shift or migrate along the shaft during use. Check their position before and during use. Do not assume a ledge is where you last placed it.
  • A ledge failing or moving while loaded may cause a sudden loss of support and a fall.

Apply weight to a ledge progressively. Do not place your full body weight on a ledge in a position where a failure would cause injury. Do not rely on a ledge to arrest a fall or hold you on exposed terrain.

Inspection and maintenance

Inspect your poles before every outing. Stop using them and contact us if you find:

  • Bends, dents, cracks, or deformation in the shaft
  • An adjustment lock that will not hold under load
  • Cracked, split, deformed, or loose rings or ledges
  • A loose or damaged grip, basket, or tip

The top cap threads onto the shaft and is user-serviceable. You are responsible for confirming it is fully seated, threaded, and secure before and during every outing. A loose or partially threaded top cap can come off during use, can allow rings and ledges to slide off the shaft, and can cause a loss of support if you are loading the upper pole. Check it whenever you adjust your ring configuration, before you head out, and during use.

The same applies to any component you install, remove, or rearrange yourself, including rings, ledges, baskets, and tips. If you reconfigure your poles, you are responsible for confirming everything is correctly seated and secure before use.

Do not modify our poles, disassemble the shaft or lock mechanism, apply heat, or use components from other manufacturers with them.

Assumption of risk

By purchasing and using twIIgs products, you acknowledge the risks described above and accept them. You agree that you are responsible for using our products within the limits of your own ability and judgment.


WARRANTY AND DISCLAIMER

twIIgs provides a limited express warranty on its products. Details are in our Refund and Warranty Policy, which is part of these Terms.

EXCEPT FOR THE LIMITED EXPRESS WARRANTY STATED IN OUR REFUND AND WARRANTY POLICY, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, twIIgs DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

twIIgs DOES NOT WARRANT THAT ITS PRODUCTS WILL BE SUITABLE FOR ANY PARTICULAR TERRAIN, CONDITION, OR ACTIVITY, OR THAT USE OF ITS PRODUCTS WILL PREVENT INJURY.

Some states do not allow the exclusion of implied warranties, so some of the above may not apply to you. This warranty gives you specific legal rights, and you may have other rights that vary by state.

Limitation of liability

To the fullest extent permitted by law, twIIgs LLC and its members, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or loss of use, arising from or related to your use of the Services or our products.

To the fullest extent permitted by law, our total liability for any claim relating to a product is limited to the amount you paid for that product.

Some states do not allow these limitations, so they may not apply to you.

Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, or any other liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold twIIgs harmless from claims, damages, and reasonable legal fees arising from your violation of these Terms, your misuse of our products, or your infringement of a third party's rights.

Events beyond our control

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including supplier or manufacturing delays, shipping and customs delays, labor disputes, natural disasters, fire, war, epidemic, or government action. If such an event delays your order, we will notify you and you may cancel for a full refund.

Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles.

Any dispute not resolved informally will be brought in the state or federal courts located in Cache County, Utah, and you consent to jurisdiction there. Either party may bring a qualifying claim in small claims court.

Before filing anything, email liam@twiigs.co. Most problems are faster to fix directly.

Other terms

Severability. If any provision of these Terms is found unenforceable, the rest remains in effect.

No waiver. Our failure to enforce a provision is not a waiver of it.

Entire agreement. These Terms, together with our Privacy Policy, Shipping Policy, and Refund and Warranty Policy, are the entire agreement between you and twIIgs.

Changes. We may update these Terms. The version in effect when you place an order governs that order. Material changes will be posted here with an updated date.
